While owning Houston rental homes can be a wise and profitable investment, it doesn't come without its fair share of headaches. Most of these "headaches" are small and easy to manage, but getting caught up in the middle of a legal battle is one big headache you and your Houston property managers want to avoid. Below are some of the most common legal mistakes made by landlords that can result in a lawsuit. So, take the necessary measures to avoid these mistakes.

 

  1. Asking Too Many Questions - You may not realize it but you can actually get in trouble for asking too many questions during an interview with potential renters for your Houston rental homes. For instance, if you are interviewing an applicant who has a disability, you could face a Fair Housing complaint if you ask about his disability and don't lease him the rental. While your decision may not have a thing to do with the disability, the Fair Housing Commission may not see it that way.

  2. Over-P+romising - There are a lot of property managers in Houston who try to get prospects to sign a lease by making promises they can't keep. You don't want to do this because if a tenant signs a lease because of one of these promises and you don't fulfill it, the tenant may take you to court over it, which will cost you time and money to sort out.

  3. Not Respecting Privacy Rights of Tenants - The majority of states require that landlords give proper notice to tenants before entering their Houston rental homes. It doesn't matter if you are going for an annual inspection or to investigate a complaint, you can't enter a tenant's home without giving adequate notice first.

  4. Failing to Maintain the Property - When you own investment properties it's your responsibility to provide adequate Houston property management which entails keeping rentals maintained. This means that when there is a maintenance issue reported, you need to fix it. It also means you should be looking at your properties to make sure there are no dangerous conditions that need to be fixed.
